Statement of the Board of the Warsaw Local Branch of the Polish Judges' Association "Iustitia" on 9th January 2024

The Board of the Local Branch in Warsaw of the Polish Judges" Association "Iustitia", in view of the wide media statements and comments against Mr. Tomasz Trębicki, Judge of the District Court for Warsaw - Śródmieście in Warsaw, in connection with his rulings issued in enforcement proceedings and the order for execution of the sentence in the case of the validly sentenced Mariusz K. and Maciej W. strongly opposes any attempts to impute any political intentions of Judge Trębicki, also in connection with his membership in the Polish Judges' Association "Iustitia".
Judge Tomasz Trębicki is first and foremost a reliable and experienced judge who, when deciding on 8 January 2024 on the execution of a validly imposed custodial sentence, acted within the limits and on the basis of the law. Giving a final court order of imprisonment on any person engaged in political activities cannot lead to different treatment from that of any other rightfully sentenced person. Equality before the law means precisely not making any exceptions in its application, regardless of who is party to the legal proceedings.
Attempts to discredit a judge in the exercise of his judicial duties by making an accusation against him for being a member of a judges' association should only be regarded as another example of unjustified questioning of the independence of a common courts which exercises the administration of justice in a fully impartial and equal manner towards all defendants.
Tomasz Trębicki, in making his decisions, could not take into account the non-substantive, potentially politically significant consequences of the case being considered, as this is not why he was appointed to the office of a judge, in a manner consistent with the Constitution of the Republic of Poland, vowing to uphold the law. The enormous media and political interest in this case did not prevent Judge Trębicki from diligently performing his duties in the executive proceedings, which certainly does not merit politically motivated attacks against him.
