Troll farm at the Ministry of Justice, or "we do not lock up for doing good"
Deputy Minister of Justice and the right hand of minister Zbigniew Ziobro stays behind an organized hate towards judges who are opposed to changes in the justice system implemented by PiS (Law and Justice ruling party).
Onet.pl has found that Łukasz Piebiak - the deputy minister of justice had arranged and controlled the action with aim to discredit the head of the largest judicial association "Iustitia".
- • Several officials of the Ministry of Justice could already harm at least 20 judges by sharing sensitive information from private life
- • What kind of information? Among others, the private address of the head of one of the judges' associations
- • Some actions were approved by deputy minister Piebiak - who is himself a judge - giving the green light to media publications. The unidentified "Boss" was supposed to be informed about the effects
- • A woman named Emilia, not employed by the Ministry of Justice, mediated between the ministry and PiS-supporting media. We know her name and keep it confidential. She also posted compromising materials on the web
- • "I know this lady from Twitter. I do not know what and where she was publishing. I will not comment the contacts with her," says. Łukasz Piebiak to Onet
The action of discrediting prof. Krystian Markiewicz, the famous critic of PiS policy and the head of "Iustitia", was based on an anonymous story containing gossip, rumours and guesses about his private life, including intimate contact with women and ways of building his position in the judicial environment. The document was handed over to the deputy minister of justice by a woman named Emilia in June 2018, although according to the correspondence we disclose below, the deputy minister had already seen this note. It was Emilia who, in cooperation with Deputy Minister Piebiak, personally discredited Judge Markiewicz: she anonymously sent the compromising materials to media. Privately, Emilia is associated with one of the employees of the National Council of the Judiciary, a judge who previously worked at the Ministry of Justice. She also proved to be an Internet hatter who, under a nickname, attacked judges in a very rude way. This is one of her Tweets regarding judge Waldemar Żurek, well known for criticizing PiS activities: "F... off!!! You bring shame to honest judges and you are a disgrace to Poland." She also wrote about Żurek "Get the f... out of Poland you scum". Our sources confirm that Emilia has given them the access to her Twitter account so it was possible to copy the history of all her entries, including deleted ones. In a conversation with Onet, the woman admitted that "she is very ashamed of what she did and that she could harm at least 20 judges with her actions". We have evidence that Emilia was in direct contact with Minister Piebiak, with whom she communicated on WhatsApp and Messenger and discussed the ways of compromising judges in social media and in pro-government media. In order to discredit Krystian Markiewicz, Emilia decided to send anonymous slanderous information from a four-page anonymous document to all local branches of the "Iustitia" Association and to MAriewicz, by mail to his home address. Onet has evidence that Łukasz Piebiak fully approved this plan before its implementation.
"We don't lock up for doing good"
Below is a fragment of conversation on the WhatsApp messenger between Deputy Minister of Justice and Emilia. We have kept the original spelling in all quoted passages. Emilia: Good morning, Minister. Is the information useful? And do we do something with them?
Piebiak: I got it earlier but I had no idea how to use it so I didn't use it. Great, if you have some.
Emilia: I have an idea like this. To send it anonymously to all branches of Iustitia. And to the person himself. Newspapers are out of question, because there is no evidence. I have a mistress's husband number. It is possible to use Internet gateways or a sim card, but I have no one to register it for [in Poland phone registration is compulsory - edit.]. I can talk to R. [here comes the name of a well-known TVP journalist]. He may have dig deeper, but there is no source and evidence, not good. What is your opinion? And will it generally help us?
Piebiak: I think it will help. It is important that it sweeps through Iustitia to let them now with whom we are dealing. People will spread it, and Markiewicz will fade, knowing what we have on him. Maybe Kuba [according to other news we've seen, it's about Jakub Iwaniec, a close associate of Piebiak] would have an idea how to spread it without leaving a trace? Emilia: Hyyymmm
Piebiak: A journalist and material would be great but I don't know if he will find such brave one
Emilia: Kuba is afraid. I think they are old friends. Ok. I will do what I can.
Piebiak: Thank you
Emilia: I will talk to journalists and send letters. Anonymously by email. But also by letters. The only problem is I don't have addresses and e-mails. I will do everything as I can, as always. I will not vouch for the result but I will try. I hope they don't lock me up.
Piebiak: We do not lock up for doing good.
Anonymous e-mails and letters with gossip about the head of "IUSTITIA" were sent to a total of about 2.5 thousand recipients. One of them was sent to the slandered Krystian Markiewicz himself by post at his home address. Emilia received this address from Deputy Minister Piebiak, who without hesitation also provided the woman with contact details of judges from the Warsaw branch of "IUSTITIA".
On June 23, 2018 at 21.16 Minister Piebiak writes back to Emilia, sending her the address of Judge Markiewicz:
Emilia: Is this his home or registration address?
Piebiak: I think both of them.
Emilia: Ok Thank you.
“When I got this anonymous letter, at the beginning I felt just surprised” - says Judge Markiewicz today. “This is not only a violation of my right to privacy, but also my personal rights. And the surprise was ordinary, human and naive, about how far will government officials go to reach their objectives. Then came the disgust, I treated this mail as a dirt that would not even stick to one's shoes, at least mine. I can manage it, but the problem is with my loved ones. Until now, it seemed to me that we were bound by the law and regulations” - adds “IUSTITIA`s” chairperson. “As a professor and practicing judge I was taught so. Unfortunately, it turned out that serious people, as they seemed to me, are starting to behave irresponsibly. This power given to irresponsible people is the most terrifying to me. Every day we decide about human life and now such decisions have been entrusted to judges who at work write anonymous letters about their colleagues. They could hit me, well, their choice. The question is why they attacked private persons and my loved ones?” - asks the judge.
Big quarrel about abortion
On June 25, 2018, Emilia reported to Piebiak about the success in sending out the materials compromising judge Markiewicz. We again retain the original spelling:
Emilia: I`ve just finished sending e-mails. Some email addresses are out of date because they they were rejected or are changed. Tomorrow I will count how much I've sent but a lot, I think about 200. I will try to send the letters to the courts tomorrow if I manage because I'm exhausted. Good night. PS. I demand a pay raise [illegible emoticons here]
Piebiak: Thank you very much. Now you need to rest to keep fighting for a good change. We shall think about pay rise [illegible emoticon]
The contents of document sent by Emilia, suggested that Markiewicz encouraged some woman to abortion. E-mails were sent from a fake account, their content includes the following sentence: "The whole truth about judge K. Markiewicz. Who is he and what has he done? Will learned pose replace moral principles, ethics and even the faith in the life of his unborn child ..." It was this passus about the alleged abortion that raised doubts of Deputy Minister Piebiak, who on June 26, 2018 at 07.18am wrote to the collaborating woman: "Ms. Emilia, maybe we shall leave this abortion as the ultimate solution?" The problem is that by this moment of hesitation, Emilia had already sent several thousand emails. This sensitive topic caused a serious quarrel between Emilia and aforementioned Jakub Iwaniec, a close associate of Piebiak. Iwaniec was against using the idea of alleged abortion in the act of compromising the head of "IUSTITIA" because he considered this thread to be unsupported rumour. The woman reported to Deputy Minister Piebiak about Jakub Iwaniec`s doubts and temporarily withdrew from cooperation:
Emilia: Good morning, Minister. I know you are in Brussels today and I do not need my person to bother you today. I would just like to inform you that I am currently resigning from working with you. I'm very sorry. I am sending you the reason for my decision and I am asking for your discretion. I trust that mutual respect and work for Poland - and at the same time this, what I got yesterday will be understood. I am asking for your discretion.
Here, the woman sends to Deputy Minister Piebiak a record of messages she received from Jakub Iwaniec.
Emilia: These are the messages I received from Kuba last night. I hope that they will remain between us. I apologize for withdrawing from the joint work. This is my decision for now. Kuba wrote that this would lead to Your dismissal, that this person has something on You. I don't want to hurt anyone and I don't want Kuba to blackmail me, threaten me or rule me. I have never done anything against you and the MS [Minister of Justice].Piebiak: It seems to me that Kuba is just afraid that this thread may become too big a fight that will sweep us away. Neither he nor I accuse you of anything. On the contrary, we can only thank you.
"Filthy Gazeta Wyborcza (GW) Interview"After temporary misunderstandings, the online hatter quickly returned to full cooperation with the deputy minister. She informed Piebiak, that the madia shall pick up the case of judge Markiewicz and that she will try to raise the interest of media again.Emilia: MK [Markiewicz Krystian] Journalist will dig. Still valid?Min. Piebiak: Of course. GW's published filthy interview with him. He deserves payback. On this day, on July 4, 2018, an interview with Prof. Markiewicz appeared in Gazeta Wyborcza, in which he spoke harshly about the lack of rule of law in Poland and accused the ruling party of violating the separation of powers. He also talked about, among others, “pseudo scandals, being prepared by the opponents of the independence of courts"
"Maybe a small scandal will explode"
Emilia's cooperation with Deputy Minister Piebiak was not limited to the case of Judge Markiewicz. Together they were also preparing a TVP (Polish public TV) media attack on judge Piotr Gąciarek from the Warsaw branch of "Iustitia".
Łukasz Piebiak already knew that internet hatter was doing everything to get interest of the right-wing media in the judge's private life - his problems with his partner he met in the internet. At the beginning of April 2018, the woman informed him that "journalist Wenerski [Przemysław Wenerski is the head of the editorial staff of the program 'Alarm!' TVP1] got in contact with lady of judge Gąciarek"
"Maybe a small scandal will break out in the Alarm program. I hope I didn't disappoint"she wrote.
The deputy of the Ministry of Justice wrote back, that "he can only be grateful for such beautiful and flourishing activities".
The TVP program about Judge Gąciarek and Pola F. whom he met on the Internet was broadcast in the program "Alarm" on May 25, 2018. The judge met her online, five years earlier, they never met in person. He sent her expensive gifts and claims that he also lent her money. When the woman ended the relationship, the judge demanded the return of the loan, which never happened. Gąciarek then notified the prosecutor's office, eventually the case ended in court, which sentenced the woman for fraud. Meanwhile, TVP introduced her as the victim of Judge Gąciarek, who was to use his professional position and acquaintance to convict Pola F.
Immediately after the broadcast of the program on TVP, Emilia asked Deputy Minister Piebiak about his impressions. He wrote to her that it was "great".
"I just send it to the Boss to make him happy" - he said.
"I heard there was a leak"
We asked Deputy Minister Piebiak about cooperation with Emilia. - I heard that there was a leak of correspondence, but I do not know what is in it, so I will not comment on this - he said.
- Do you know Ms. Emilia?
- Yes, from Twitter.
- Did you correspond in person?
- I will not speak on this subject.
- Have you consulted the operation of sending anonymous slandering Judge Markiewicz?
- I don't remember our contacts in the Markiewicz case. That's all I have to say on this matter. I'm on vacation, ”added the deputy minister.
