Polish Judges Association "Iustitia” National Board`s position on the statement of Prime Minister Mateusz Morawiecki for the French daily "Le Figaro"

This is another statement of the Prime Minister of the Republic of Poland given in foreign media, which offends Polish judges and we find it unacceptable. It is another attempt to mislead European public opinion and suggest that taking political control over judiciary was necessary due to corruption of the Polish judges. Such reasons were already presented by the Ministry of Justice in 2016. When we asked for access to the data on which this claim was based, it turned immediately out that there were no such data. In the renowned Rule of Law Index 2017-2018, the resistance rate of Polish courts against corruption was very high (0.86 - maximum resistance rating is 1 point), unlike legislative (0.56) or executive (0.68) power.

The changes introduced during last 3 years, that are defended by the Prime Minister have indeed an impact on corruption, but in our opinion is quite opposite to what the PS is saying: the introduced changes in reality make the potential political corruption even bigger, for example through the arbitrary allocation of various functions in the courts by politicians and their nominees. From the very beginning, we criticized the attitude of those judges who decided to cooperate with politicians in destroying the independence of the Polish judiciary. For this reason, we have become the target of attacks from politicians. We declare with full determination, that we will continue to defend the reputation of Polish judges and we will not agree to political control over the courts.
