The European Commission has referred Poland to the CJEU for violation of EU law by the Constitutional Court.
The European Commission decided on 15 February 2023. decision to refer Poland to the Court of Justice of the European Union for violation of EU law by the Polish Constitutional Court and its jurisprudence.
The Commission opened infringement proceedings against Poland on 22 December 2021 by sending a letter of formal notice. This followed rulings by the Polish Constitutional Court on 14 July 2021 and 7 October 2021, in which it declared the provisions of the EU Treaties incompatible with the Polish Constitution, explicitly questioning the supremacy of EU law. The Commission's aim is to ensure that the rights of Polish citizens are protected and that they can enjoy the benefits of the EU in the same way as all EU citizens. The primacy of EU law ensures that EU law is applied equally throughout the Union.
