Response from the EU Justice Commissioner to the letter from the Judges' Associations.
EU Justice Commissioner Didier Reynders, replying to the Presidents of the Judges' Associations on behalf of the President of the European Commission, indicates that concerns about the independence of the NCJ in its current form have not been allayed, despite the fact that in a number of judgments the European Court of Human Rights has found the process of appointing judges to the Extraordinary and Public Accounts Chamber and the Civil Chamber of the Supreme Court to be intrinsically flawed. The Court adopted the above position due to the participation of the NCJ devoid of independence from the legislative and executive powers and the appointment of judges on the basis of a resolution of the NCJ in a procedure devoid of effective judicial protection and despite the suspension of the implementation of the resolution.
