Constitutional Court turns a blind eye to violations of the Constitution by the Parlament.

During the COVID-19 epidemic, the Polish parliament passed legislation in violation of the constitution, according to Andrzej Zielonacki, a judge at the CC. And the CC is discontinuing proceedings in a case concerning the issue.

"I would like to point out that in recent years (and especially after March 2020, i.e., under the so-called COVID legislation) the legislative practice of the Polish parliament in a large number of cases blatantly violates constitutional standards." - Andrzej Zielonacki does not leave a dry thread on the current legislation. He presented his assessment in the justification of a dissenting opinion to one of the most recent decisions of the Constitutional Court in which it discontinues proceedings relating to changes in criminal law introduced when the so-called Shield 4.0 legislation was enacted (ref. P 5/22).
